  1. Will I be responsible for legal fees?

No – all asbestos related illness claims are pursued on a ‘No Win, No Fee’ basis and if your case is successful, we do NOT make any deductions from your compensation in respect of this firm’s Legal Fees.  Additionally, we will not seek to recover the firm’s incurred legal fees from you in the event your case is not successful.

  1. What if the company I worked for is no longer in existence?

Where a company is no longer in existence we at James Murray Solicitors have great resources both internally and externally to locate employer liability insurers who would be responsible for the claim.

Where appropriate, we will restore dissolved companies to the Companies Register which provides the opportunity to you and any one else who has suffered an illness as a result of their negligence to pursue a claim.

  1. Is there a time limit for claiming compensation?

The general rule is that a case must be brought within three years usually from the date of diagnosis. However, it can also be assessed from the date of knowledge i.e the date that you knew or ought to have known that you were suffering from an asbestos related illness.

In the event of a person passing away from an asbestos related illness, a claim can be made by you on the deceased’s behalf.  The time limit will begin at the date of death and will last for a period of three years from that date.

  1. How long will my case take?

It is difficult to put a time scale upon this as it can depend on a number of factors. Our Specialist Team work closely with Barrister’s and Medical Experts to bring cases to a prompt conclusion. We also issue Court Proceedings out of the Royal Courts of Justice who have a specialist team of Masters (Judges) who strive for a swift resolution for asbestos related claims.

  1. Will I have to attend appointments?

All legal visits including with your Barrister can be completed at your home address and at your convenience. If you are in poor health and have restricted mobility, the Medical Experts will also endeavour to attend upon you at your home address.

  1. Will my Claim go to Court?

In the vast majority of cases, our Specialist Team resolve all claims without the need for litigation and a Trial.

However this is not always possible as external factors may influence the path of the case.

Your case will be run by a Specialist Solicitor and dedicated Barrister who will meet with you to discuss your case and should Court Proceedings be issued, your team will be on hand to guide your case through the Proceedings and will bring the case to conclusion.
